These Terms of Service ("Terms") govern your use of Heard — In Person ("Heard"), operated by Prayash LLC ("we," "us"). By creating an account, setting up a kiosk, or leaving a review, you agree to these Terms. If you do not agree, please do not use Heard.
Heard is a platform that lets brick-and-mortar businesses collect verified, in-person customer feedback on a tablet or kiosk at their place of business. Reviews are collected on the business's own device, in person, which is central to Heard's promise of authentic feedback.
You must be at least 18 years old and able to form a binding contract to create a business account. By creating an account, you confirm that the information you provide is accurate and that you are authorized to represent the business you register.
If you leave a review, you confirm the feedback is your own honest experience. You agree that the business you reviewed may see your feedback and contact details and may respond to you. Your contact information is handled as described in our Privacy Policy and is never shown publicly.
You agree not to: misuse or interfere with the service; attempt to gain unauthorized access to Heard's systems or data; use Heard to violate any law; or use automated means to collect data from the service. Heard is intended for genuine, in-person feedback — not for artificially generating, inflating, or suppressing reviews.
You keep ownership of the content you submit. By submitting content, you grant Prayash LLC a non-exclusive license to host, store, display, and use that content as needed to operate and provide Heard (for example, showing a review on a business's public profile and delivering it to the business).
If Heard offers paid plans, the applicable fees, billing terms, and cancellation terms will be presented to you before you are charged. During any free pilot or trial, no fees apply unless we tell you otherwise in advance.
We work to keep Heard running reliably, but we provide the service "as is" and do not guarantee it will always be uninterrupted or error-free. We may modify, suspend, or discontinue features over time.
To the fullest extent permitted by law, Heard and Prayash LLC are not liable for indirect, incidental, or consequential damages arising from your use of the service. Heard is a tool for collecting and displaying feedback; we are not responsible for the accuracy of reviews submitted by customers or for interactions between businesses and their customers.
You may stop using Heard and close your account at any time. We may suspend or terminate access if you violate these Terms or use the service in a way that harms others or the platform.
We may update these Terms as Heard grows or as the law changes. When we make material changes, we will update the date above and, where appropriate, provide additional notice.
These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws principles.
